Termite Issue

In this instance, we attended a BSA dispute on behalf of the builder. The home owner had a problem with termites to the interior. Extensive landscaping had been done since taking possession, and where soils had been disturbed and/or slabs laid, the home owner had engaged the builder's pest controller to retreat the areas. The entry point could not be positively identified without removing bricks and cutting external concrete slab, but the constant was that termites had occurred from an area the pest controller had treated.
Without anything to suggest the original pest treatment had failed it was our belief the builder had complied with their duty of care, and substantial representations were made to the Building Services Authority management through the Queensland Master Builders Association. A BSA direction to rectify (repairs and treatment) was obtained against the pest controller involved, without a direction being issued against the builder.
